Introduction of the Guidelines Governing Allocation of Grid Capacity for Offshore Windfarms at Zonal Development Phase

In order to promote renewable energy, for offshore wind projects, the Ministry of Economic Affairs (MOEA) plans to develop Taiwan offshore wind industry through three phases, i.e., "Demonstration Phase", "Potential Site Phase", and "Zonal Development Phase". The first and second phases have made great success. To continue the promotion of offshore wind industry in the third phase, the MOEA announced the "Guidelines Governing Allocation of Grid Capacity for Offshore Windfarms at Zonal Development Phase" (離岸風力發電區塊開發場址容量分配作業要點; "3rd GA Rules") on August 19, 2021 (Ref. No.: Gin-Neng Zi No.: 11004604420) under which a total of 15GW grid capacity will be allocated from 2026 to 2035 with details summarized below; among the 15GW, 9GW will be allocated in the first stage ("Stage I") through three phases from 2026 to 2031.

To be allocated between 2032 and 2035 with detailed schedule to be determined taking into account the development status of Phase 1 to Phase 3 above and the international technological development.
 
Each allocation will be proceeded through two phases, i.e., "Contract Performance Review" and "Bidding Process". In the "Contract Performance Review", the MOEA will examine each applicant's capability in contract performance via three key aspects, i.e., the applicant's technical capability, financial capability and localization proposal. Only those applicants that pass the "Contract Performance Review" may participate in the "Bidding Process". In the "Bidding Process", the applicants will be ranked through their bidding price (lowest price will be ranked the first place) and the grid capacity and connection year will be allocated in accordance with the applicants' rankings.
 
The maximum capacity to be allocated to each wind farm developed by the same developer is 500MW in principle, provided that the MOEA may, at its discretion, grant additional 100MW by taking into consideration of completeness of wind farm, development efficiency, and grid capacity. With respect to the bidding price, the bidding price for Phase 1 of Stage I is capped at 2.49 (NT$/kWh) under the 3rd GA Rules; for the remaining Phases, the bidding price is capped at the figure calculated by the weighted average of the bidding price and the grid capacity of the applications awarded with grid capacities in the previous Phase. Zero (NT$/kWh) is the floor price for each Phase.
 
With respect to the determination of "same developer", the 3rd GA Rules indicate that any application involved in any of the following circumstances will be deemed as developing by same developer:
 
       (1)    The external representative of two or more applicants is the same; or
       (2)    Any of the promoter(s), shareholder(s), or general partner in a fund who directly or indirectly holds 20% or more of the shares in the applicants is the same.
 
After the grid capacity is allocated, the MOEA will announce the rankings among the applications and the allocation result. After the successful bidder signs a grid allocation administrative contract with the MOEA, the MOEA will issue its consent on installation of offshore wind facility (which is one of the requisite documents for application of establishment permit for offshore wind projects under the Electricity Business Registration Regulations) to such bidder and the bidder should obtain the establishment permit within the following 2 years. The applications for Phase 1 in Stage I should be filed by September 30, 2022. The MOEA schedules to announce the allocation result by the end of this year or early next year after the "Contract Performance Review".
