On April 20, 2003, the Economics Committee of Legislative Yuan reviewed and approved the draft revision of the Trademark Act mainly in accordance with the version proposed by the Executive Yuan. The main content and impact of the draft revision are summarized below:
1. Expedited examination of trademark registration applications:
Upon payment of the examination fee by the applicant, the trademark authority will conduct the examination within two months, allowing the applicant to obtain the right to a trademark registration more quickly.
2. Regulation of trademark agents:
A trademark agent must pass a professional certification exam held by the trademark authority or have worked for a period of time in trademark practice, and complete annual on-the-job training to continue employment in trademark agency services.
3. Trademark registration applications that have been rejected or require amendment are ineligible for expedited examination.
Impact:
1. The examination timeframe for trademark registration applications will be shortened to within two months. This will expedite the acquisition of trademark registration rights and improve trademark protection.
2. Trademark agents will be subject to stricter professional competence regulations, which will help to improve the quality of trademark agency services and protect the rights of applicants.
