Electronic Patent Certificates Available in Taiwan from January 2023

Electronic Patent Certificates Available in Taiwan from January 2023

On 16 November 2022, the Taiwan Intellectual Property Office (TIPO) announced that, from 1 January 2023 onwards, patent applicants will be offered the option to receive electronic patent certificates instead of paper copies. This marks another important step for the TIPO towards going green and paperless.

According to the TIPO's announcement, starting from 1 January 2023, applicants need to choose between a paper patent certificate and an electronic patent certificate when paying the requisite fee to complete the grant phase.

The format and text of the electronic patent certificate will be the same as the current patent certificate, and the official fee for the electronic patent certificate also remains unchanged. The electronic patent certificate will employ a fraud-proof design including an authentication QR code linking to the TIPO's webpage showing the most updated information on the patent.  Applicants choosing to receive an electronic patent certificate will be allowed to later apply for a paper patent certificate with an additional official fee of NT$1,000.  A copy of the electronic patent certificate, on the other hand, will not be available after a paper patent certificate is issued.

In view of the TIPO's plan to reject requests for an electronic patent certificate once a paper patent certificate has been issued, starting from 1 January 2023, our firm will normally assist clients apply for electronic patent certificates, in order to best protect our clients' rights and interests.
