Effectiveness of Cross-Strait IP Rights Coordination and Handling Mechanism



In order to protect Taiwanese enterprises' intellectual properties, Taiwan and China signed the "The Cross-Strait Agreement on Intellectual Property Right Protection and Cooperation on 29 June 29 2010.  The Agreement establishes a communication platform for the administrative agencies on both sides and an implementation mechanism of collaboration, coordination, disposition and consultation.  The one of the main objectives of the Agreement is to assist in resolving various intellectual property disputes and to provide administrative assistance to Taiwanese enterprises in China with IP issues.

 
According to Taiwan Intellectual Property Office's (TIPO's) statistics, from the time the Agreement came into effect to the end of December 2013, the number of successful negotiations of disputes by TIPO had totaled 539, of which 507 cases (94%) are trademark disputes.  TIPO effectively examined and provided legal assistance and consultation for all the trademark cases.  Additionally, TIPO notified its China counterpart and facilitated the information sharing for 391 cases that are not yet decided by the China administrative agencies.  Up until now, 216 cases have been processed and decided; the other 175 cases have not been resolved due to unsolved disputes.
