The NDC took over the responsibility of interpreting the PDPA



While the enforcement of the Taiwan Personal Data Protection Act (“PDPA”) is administered by local government authorities and central competent authorities in charge of relevant industries, pursuant to Article 55 of the PDPA, the Ministry of Justice (MOJ) is responsible for establishing the Enforcement Rules of the PDPA and answering questions from government and non-government agencies regarding how to interpret and comply with the PDPA. However, in order to enhance the cooperation among ministries and commissions and ensure consistent application of the PDPA, on January 10, 2019, the MOJ officially announced that the National Development Commission (NDC) will take over such role from the MOJ thereafter. In fact, on July 4, 2018, in response to the implementation of the General Data Protection Regulations (“GDPR”), the NDC has already established a project office responsible for coordinating GDPR-related matters and seeking the “adequacy decision” from the European Union (EU).
