Business and Legal Trends Affecting IP in the US
This seminar explores two new trends that will impact IP in the US in years to come.  First, Litigation Funding is quickly transforming our legal system by enabling everyone from startups to Fortune 100 companies finance their litigations and share legal risk. Our law firm has more litigation funded matters than most other firms. From this perspective, we will explain how litigation funding works and how funding can help you defend your IP without breaking the bank. Secondly, Greenwashing & Sustainability have become major litigation battlegrounds for trademark owners that use labels such as ECO-FRIENDLY, RECYCLED, ORGANIC, and SUSTAINABLE. Large brands like Volkswagen, McDonald's, Coca-Cola, IKEA, and H&M have sued, and startups and smaller companies are not immune. We’ll explore how we won a recent fight for our client H&M, and share lessons learned.
 
Speaker: Stephen D. Zubiago

Stephen D. Zubiago is CEO and Managing Partner of Nixon Peabody LLP, an AmLaw 100 firm with 150+ year history in the US. Steve leads 1,250 colleagues, including 600+ attorneys, in 15 offices worldwide. Steve graduated from Brown University and earned his law degree from Marquette University Law School. He clerked for Justice Donald Shea of the Rhode Island Supreme Court. Steve joined Nixon Peabody in 1999, became a Partner in 2002, and served in several management positions in firm before being selected to be the firm CEO in 2021. Steve is focused on enhancing relationships with clients, establishing relationships with new clients, attracting, and retaining top talent, and anticipating and capitalizing on future opportunities that can contribute to clients’ success.

Instead of academic theory – we’ll share case studies to demonstrate how we’ve helped our clients around the world – from Fortune 500 to startups – monetize their IP by: (1) blocking competitors; (2) cross-licensing with aggressors; (3) increasing valuation for funding; (4) turning one invention into 100; (5) extracting value from alternatives; (6) licensing brands; and many more.
 
Speaker: On Lu

On Lu specializes in monetizing IP to generate revenue, defend against litigation, and cross-license with competitors. He works with some of the most prestigious tech titans in Asia, Europe, and the U.S. to create IP strategies that convert IP cost centers into profit centers. oN leverages a decade of extensive litigation experience before the ITC, and in federal district courts around the country. oN also serves as Chief IP Officer for the European Innovation Academy, and regularly teaches the IP curriculum he created that has trained 7,000+ startups from 90+ countries. Before becoming a lawyer, oN earned his M.B.A., and spent a decade launching U.S. dot.coms internationally.

台灣專利訴訟自2023年8月30日起因新修正之智慧財產案件審理法相關規範施行進入新篇章，本場次將以智慧財產及商業法院成立以來台灣專利訴訟之相關數據及實務面臨之挑戰出發，一窺新法施行後之實務樣貌及提出企業進行台灣專利訴訟之策略建議。
