Ministry of the Interior Promulgates Standards for Installing Photovoltaic Generation Equipment on Buildings

On December 19, 2025, the Ministry of the Interior and the Ministry of Economic Affairs jointly promulgated the Standards for Installing Photovoltaic Generation Equipment on Buildings (the “Standards”) pursuant to Paragraph 2, Article 12-1 of the Renewable Energy Development Act. The Standards set out specific requirements regarding the entities subject to compliance, installation thresholds, exemption conditions, and application procedures for the installation of photovoltaic generation equipment on buildings exceeding a prescribed scale. Key provisions of the Standards are summarized below:
1. Scope of Applicable Buildings
Except for Category E (religious and funeral use) and Category I (hazardous materials) buildings under the Building Technical Regulations, the Standards apply to all other building categories under such Regulations (namely, Category A (public assembly), Category B (commercial), Category C (industrial and warehousing), Category D (recreational and cultural education), Category F (health and welfare), Category G (office and service), and Category H (lodging); collectively, “SolarEligible Buildings”).
2. Installation Thresholds and Calculation Method for Installed Capacity
Solar Eligible Buildings that meet the following conditions shall be required to install solar photovoltaic generation equipment with a specified installed capacity, to be installed by the builder, unless the electricity transmission and distribution enterprise (currently, Taiwan Power Company) determines that the required installed capacity may be reduced:

3. Exemption Conditions
Solar Eligible Buildings meeting any of the following conditions may be exempt from the requirement to install photovoltaic generation equipment:
(1) Buildings with insufficient sunlight
Solar Eligible Buildings may be exempt from installing photovoltaic generation equipment if their projected annual power generation per kW falls below the regional benchmarks listed below due to insufficient sunlight, as demonstrated by a power generation simulation assessment report.

The foregoing power generation simulation assessment report shall be issued by a professional assessment institution designated by the central competent authority and commissioned by the builder.
(2) Buildings deemed unsuitable by the building authority
Solar Eligible Buildings deemed clearly unsuitable for the installation of photovoltaic generation equipment due to structural characteristics, special occupancy purposes, or other circumstances, as determined by the building authority, may be exempt from the installation requirement.
4. Technical and Safety Requirements of Photovoltaic Generation Equipment
Photovoltaic generation equipment installed in accordance with the Standards shall comply with the following requirements:

1. Issued by a laboratory accredited by the Taiwan Accreditation Foundation and showing compliance with National Standards of the Republic of China (CNS) 61215; or
2. Passing the IEC 61215 static mechanical load test with positive and negative loads exceeding 5,400 Pa (withstanding Category 17 gale-force winds)

Circuit Design
|
The equipment must be able to supply electricity to the building even when the power grid fails or when the equipment becomes isolated from the grid.

Site
|
Permanent maintenance equipment (e.g., access walkways, stairs, guardrails) must be installed in accordance with Article 29 (Work Ladders), Article 37 (Fixed Ladders), and Article 227-1 (Fall Hazards) of the Occupational Safety and Health Facilities Regulations.

5. Application Documents and Handover Procedures
In accordance with the Standards, the builder shall submit the relevant documents or complete the required procedures at the following stages:

The builder shall complete the change of installation entity on the certification documents of the renewable generation equipment, designating the building owner, management committee, or other legally responsible management entity as the installation entity.

6. Consequences of Non-Compliance
Currently, the Standards and the Renewable Energy Development Act do not stipulate specific penalties. However, non-compliance may affect the issuance of building and occupancy permits, as well as the legal determination of equipment ownership.
The effective date of Article 12-1 of the Renewable Energy Development Act and the Standards is pending a decision by the Ministry of Economic Affairs. Nevertheless, future new construction, expansion, and renovation projects will be subject to the Standards regarding building management and development planning. 內政部訂定「建築物設置太陽光電發電設備標準」

內政部與經濟部於民國114年12月19日依再生能源發展條例第12條之1第2項會銜公告「建築物設置太陽光電發電設備標準」(下稱「本標準」),就一定規模以上建築物應設置太陽光電發電設備之適用對象、設置門檻、免除條件及申請程序等事項,訂定具體規範。茲就本標準之重點內容摘要說明如下:
1. 適用建築物範圍
除建築技術規則下之E類(宗教、殯葬)及I類(危險物品)建築物不適用外,本標準適用於建築技術規則其餘類別建築物(即A類(公共集會)、B類(商業)、C類(工業、倉儲)、D類(休閒、文教)、F類(衛生、福利)、G類(辦公、服務)及H類(住宿);合稱「設置光電建築物」)。
2. 設置門檻及發電裝置容量計算方式
設置光電建築物符合下列情形者,應由起造人設置一定裝置容量之太陽光電發電設備,惟經輸配電業(即台灣電力股份有限公司)認定得減少裝置容量者,不在此限:

3. 豁免條件
設置光電建築物符合以下任一條件者,得免設置太陽光電發電設備:
(1) 受光條件不足者
設置光電建築物如因受光條件不足,其每瓩全年模擬發電量未達以下各地區基準值並經發電量模擬評定報告書佐證者,得免設置太陽光電發電設備。

上述所稱「發電量模擬評定報告書」應由起造人委請中央主管機關指定之評定專業機構出具。
(2) 經建築主管機關認定不宜設置者
設置光電建築物如因構造、使用用途特殊或其他情形,經建築主管機關認定顯然不宜設置太陽光電發電設備者,得免依規定設置。
4. 光電設備技術與安全規範
依本標準設置之太陽光電發電設備應符合以下規定:

依本標準規定,起造人於不同階段,應配合提出相應之文件或完成相應手續:

6. 違反效果
本標準及再生能源發展條例目前未另設罰則,惟如未符合相關要求,將可能影響建築執照及使用執照之取得及設備所有權之歸屬。
