Opening vs. Protectionism - Taiwan Industrial Policy and Survival Strategy
    Time:09:00 – 12:00, September 4, 2015 (Friday)
Venue:Howard Civil Service International House, Taipei, Taiwan
(No. 30, Section 3, Xin Sheng South Road, Da'an Dist., Taipei City)
    Introduction:
Enervated by World War II, Taiwan was able to step out from the Cold War era because of the hard work of its people during that time. The past 50 years saw Taiwan struggle to make hard choices in its march from insularity to liberalization. It strove to attract overseas investment, encouraged exportation, adopted deregulation policies, and witnessed an exodus of manufacturers from Taiwan to mainland China and other foreign countries. In the constantly shifting global economy, there is one thing that remains unchanged: economy and trade are still Taiwan's lifeline. Nevertheless, Taiwan has yet to realize the vision of becoming the Asia-Pacific regional operations center. In the global economic decline precipitated by the 2008 financial tsunami, Taiwan also faced new internal and external challenges. Externally, Taiwan now faces trade marginalization as the regional economies rapidly integrate, creating new, emerging Asia-Pacific forces. Internally, the chasm separating the rich and the poor has widened, sparking a debate over policies of "whether pursuing wealth or equality should have priority". Moreover, internationalization and deregulation also appear to be adjustable. Looking into the future, to cope with the intense international competition and the ever-changing relations across the Taiwan Straits, Taiwan must reorient itself and chart a new course. The focus of the opening summit is: What kind of industry policies and prescient judicial reform will see Taiwan through the new global economic order?

    Introduction:
Foreign investment plays a vital role in Taiwan's economic development. Lee and Li, Attorneys-at-Law witnessed the changes in foreign investment in Taiwan over the past 50 years. Today, Taiwan's industries are forced to undergo structural readjustment, and foreign investment has hit a bottleneck. One of the pressing issues regarding Taiwan's competitiveness will be how to attract foreign investment and create opportunities for overseas investment and corporate mergers and acquisitions through deregulation (e.g., the establishment of Free Economic Pilot Zones). Also, while corporate mergers and acquisitions may also be one means of industry structural adjustment and transformation, the day after the merger is usually when the real trouble begins. In this forum, issues that may arise from corporate mergers and acquisitions will also be discussed through case studies.

Venue:Howard Civil Service International House, Taipei, Taiwan
(No. 30, Section 3, Xin Sheng South Road, Da'an Dist., Taipei City)
    Introduction:
The "judicial review system" adopted by many democratic constitutionalized countries is a key factor for the development of the rule of law in the era of globalization. Because of the transnational intertwinement of legal orders, the controversial issues regarding constitutional human rights often occur beyond state boundaries and the framework of local values, thereby becoming global human rights issues that receive extensive attention. The development of the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR) promoted the generalization of human rights and the proliferative transnational effects, influencing the practice and function of the judicial power of each country. This Symposium will treat the development of the rule of law in the era of globalization as the main theme. It will first explore the effect and impact of the judicial review system, and at the same time discuss the outcome of the implementation of the ICCPR and the ICESCR and the constitutional rights in the administrative litigation practice, both of which will be the topic of discussion of this Symposium.

    Introduction:
Corporations play a critical role in helping the rule of law take root in a society. Meanwhile, the rule of law is the bedrock of market economy. Legal compliance and strong corporate governance are the key to curbing legal risks and seizing a competitive edge, and pave the way for the fulfillment of a company's corporate social responsibility (CSR), which encompasses ecological conservation, environmental protection, consumer protection, labor rights and interests, and strict compliance with taxation obligations. Because of globalization, "ethics today, law tomorrow" rings truer than ever. Therefore, stringent rules on corporate governance are indispensable for navigating the rapid changes in social norms and law. Besides, to observe the company's ethical rules and protect the shareholders' rights, guidelines should be clearly prescribed for undertaking public-interest and charitable activities.
